 Superannuation Borrowing Services  

Our Superannuation Borrowing service includes the following;

As an introduction we provide a comprehensive analysis of this type of investment tool. We also provide a cost calculator for a property warrant that assists you to determine the numbers that surround the purchase you are considering.

 

Once you have decided you are interested in using a warrant you will need to establish a self managed super fund. If we establish that for you then the deed will cover all the necessary provisions. If you have an existing deed then we will need to check if your deed;

  1. allows a borrowing or 

  2. allows a borrowing to the loan to valuation percentage you require and

  3. allows the fund to hold a beneficial interest in an asset legally held by a custodian

Please note that the Fund Investment Strategy must include provision for the warrant and, in particular, its effect on

  1. risk and return

  2. cash flow

  3. diversification and

  4. liquidity requirements

Our documentation, individually prepared by lawyers, provides the following:

  5. 3 copies of the instalment warrant deed

We can also provide assistance with the following:

 

Where a non-arm's length acquisition is being undertaken checking whether the acquisition is permitted under one of the exceptions to the prohibitions against acquisition of assets from related parties and checking if the arms length rule has been properly considered both in terms of the acquisition price and ongoing lease arrangement (if applicable)

 

Where a non-arm's length borrowing is being implemented checking that the interest rate applicable is not in breach of the market value rules and providing a non-arms length loan agreement

 

Where institutional funding is sought we can provide assistance in determining a suitable source of finance and assist in liaison with the lender as reasonably required.

 

Where required, and at extra cost, we will establish one or more of the following;

  1. a new and advanced "Strategist" self managed superannuation fund deed

  2. a deed upgrade to the "Strategist" deed terms and conditions

  3. a purpose built Self managed superannuation corporate trustee

  4. a corporate trustee for the Instalment Warrant trust

We also offer a full ongoing administration and compliance service for your self managed super fund. This will also include any instalment warrants in which the Fund is invested. We do not offer any ongoing compliance service for instalment warrants that are not within a fund we administer.
